JP By The Sea Vacation Rentals Agreement:
The accommodations are owned by “JP By The Sea” as vacation rentals accommodations for the Guest according to the following “Terms and Conditions”.
The Guest agrees to follow the restrictions set forth by “JP By The Sea” and shall be responsible for any and all guests, for adherence to the restrictions.
Bookings shall be confirmed in writing by e-mail on approval of application and on receipt of credit card information (Visa, Master Card, Discover or Amex). A Preauthorization of $250.00 (safety deposit) will be done on the CC in file 30 days prior arrival.
50% of the payment is due 48h prior of the arrival day and the balance is due and payable on the date of arrival. The issuance of written confirmation to the Guest by “JP By The Sea” shall complete a binding contract between the Guest and “JP By
The Sea”. All payments are made to “JP By The Sea”.
4- CHANGES IN ACCOMMODATION
Request to make changes to earlier booked accommodations can be made on request, the earlier the better and will be accommodated based on availability.
Any cancellation received less than 2 days prior to midnight 00:00h (Pacific Standard Time) on day of arrival is subject to a fee equal to no more than one night’s rental.
The information and images contained in any printed or on-line material is believed to be accurate at the time of publication or posting. “JP By The Sea” reserves the right to make any changes it deems necessary to, more accurately, reflect the Vacation
TV’s, DVD player and DVD’s and other such equipment are supplied at the discretion of the Owner as an added feature for the Guest. While every attempt will be made to ensure that such equipment and all other appliances are in working order for the Guest’s vacation,
should any breakdown or other situation occur whereby these items are not available for the term of the rental period, “JP By The Sea” does not take responsibility for replacing or refunding the Guest for the lack of use of these elements.
7- OCCUPANCY (Cottages only)
Guests who have overnight guests at the property in excess of the available accommodation (ie: equipped beds) of that accommodation are not permitted. Guests are welcome to hold gatherings at the accommodation provided they adhere to rules in Section 8 with
regard to consideration for neighbours in the Community.
Sub-letting of the property is not permitted.
Separate camping, tenting, campers or other additional accommodation facilities are not allowed. Please note that ANY person, REGARDLESS of age is counted as a person in the occupancy of the accommodation.Check-in and Check-out
times are to be adhered to, unless otherwise arranged with “JP By The Sea”. Early arrival and/or late departure may result in additional charges.
Check-In is 1600hrs. Check-Out is 1100hrs, (Pacific Standard Time) for all accomodation.
Smoking is not permitted inside the Cottages, Condominiums including balconies. Please refer to the Strata bylaws included in the guest book. A $250.00 fine can and will be charged
to the Guest if found to be smoking inside the Cottages, Condominiums or on the balconies.
8- THE COMMUNITY
Cottages:The Guest acknowledges, reads and agrees to follow the Bylaws & Rules of the Wild Coast Cottages as posted in the Guest Information Binder in the Cottage. This includes but is not limited to the
proper care and use of the wastewater management system (Treatment Plant).
Condominium:The Guest acknowledges, reads and agrees to follow the Bylaws & Rules of UNION STRATA as posted in the Guest Information Binder in the Condominium. This includes but is not limited to the proper
care and use of the parking facilities and elevator. The use of the underground parking at the condominiums is at the Guest one risks.
Pets are welcome only in cottages designated as ‘Pet Friendly’. Guests will supply their own bedding for their pets. Pets are not permitted anywhere on the furniture. Outside, pets must be kept on a leash on the Cottage property or anywhere
in the Cottage Community. Guests will ensure that any deposits made by pets on the Cottage property or its adjoining structures, and Community are duly and properly disposed. Damage and/or extraordinary soiling to the Cottage or its adjoining structures committed
by Guest’s pets will be subject to additional charges to Guest’s credit card in amounts at the discretion of “JP By The Sea”. PETS are not permitted in the Condominium. A $250.00 fine can and will be charged
to the guest if evidences can prove that a Pet was brought in the condominiums.
10- INVENTORY/HOUSEHOLD RULES/ CLEANING
The Guest is expected and kindly asked to leave the Cottage and Condo in the same condition that it was in upon their arrival. Laundering of linens and towels is done by “JP By The Sea” at no extra cost to the Guest. The Guest is responsible for emptying
the refregerator, cleaning and returning all dishes to their stored locations and removing their own garbage and recycling to the appropriate designated disposal area.
Guest agrees to read and follow the Guest Information Binder in the Cottage and Condominium, and to use the inventory and equipment in a safe and responsible manner.
Any additional cleaning required, breakage or damage to inventory, equipment or any other part of cottage or Condominium property, above and beyond normal “wear and tear” will result in additional charge to the Guest’s credit card. Linens and towels are provided.
Guests are advised that lost or stolen personal items are not the responsibility of “JP By The Sea”. Guests will have access to the property via a door code and will be solely responsible for locking of the Cottage and safekeeping of personal items during
(Condominium Urban Den) Guests will be provided with a FOB (Remote Access Key) to access the underground parking lot and the condo, Security is of the outmost importance and will be solely responsible for locking
of the condo and safekeeping of personal items during their visit. The Guest is responsible for the FOB, if the FOB is lost or not returned to the condo at the end of the visit the Guest credit card will be charge to the amount of 200$ for the cost of the
disabling the lost FOB and the cost of the replacement.
“JP By The Sea” will not be liable for any consequential damages, loss or expense arising out of or in connection with the use of either one of the Cottage, the Condo, the parking facilities or the inability to use the
Cottage or the Condo for any purpose whatever. "JP By The Sea"’s maximum liability for all damages, losses and causes of action, whether in contract, tort or otherwise, shall not in any case exceed in aggregate the contract price for the rental.
Cottages: Park only on the cottage driveway or use the visitor parking lot at the cottages.
Condo: Parking space for only one vehicle in the underground parking (There is no visitors parking space).
13- The parties agree that this contract shall be governed by the laws of the Province of British Columbia and agree to attorney solely to the jurisdiction of the courts of British Columbia with respect to any
and all disputes arising out of the interpretation and application of this contract and the relationship between “JP By The Sea” and the Guest. A $250.00 fine can and will be applied if theses Terms and Conditions are defied.
